Privacy Policy

What personal data the Service collects, why, how long it is kept, and how you exercise your rights over it.
1. Controller
AudioFie operates the Service and is the controller of the personal data described here.
Data protection enquiries: support@audiofie.com. Support in Telegram: @audiofieBot (https://t.me/audiofieBot).
No Data Protection Officer is appointed: the Service does not carry out large-scale monitoring or process special categories of data, which are the grounds that make an appointment mandatory. If that changes, the contact details will appear here.
2. What we collect
- Account data — email address, display name, password hash, and the language and theme you have chosen.
- Listening activity — recordings played, skipped, liked and disliked, playlists and queues you build.
- Uploads — recordings, artwork, lyrics and metadata submitted by artists, together with the technical properties of those files.
- Technical data — IP address, approximate location derived from it, device and browser type, operating system, and timestamps of requests.
- Support correspondence — messages you send us and our replies.
3. Data stored in your browser
The Service keeps some settings locally on your device rather than on our servers. This data is not personal data on our side because we never receive it.
- nmp:theme — light or dark appearance.
- nmp:lang — interface language.
- nmp:audio — equaliser settings, streaming quality preference, crossfade mode and length.
- nmp:videos — your list of saved music videos.
- nmp:plyr — volume and quality chosen inside the video player.
4. Why we process it, and on what basis
- To provide the Service and your account — performance of a contract with you.
- To keep the Service secure, prevent abuse and investigate incidents — our legitimate interest in a safe platform.
- To improve the catalogue and recommendations — our legitimate interest, balanced against your rights; you may object at any time.
- To handle copyright complaints and comply with orders from courts and authorities — compliance with a legal obligation.
- To send marketing messages, where offered — your consent, withdrawable at any time.
5. Cookies and similar technologies
We use technically necessary storage to keep you signed in and to remember your settings. Where analytics or advertising technologies are introduced, they will be loaded only after you consent through a cookie banner, and refusing will not restrict access to the Service.
6. Who we share data with
We do not sell personal data. We share it only with service providers acting on our instructions under a written processing agreement — hosting, content delivery, email delivery, payment processing and error monitoring.
We also disclose data where required by law, to enforce our terms, or to protect the rights and safety of users and third parties. Rights holders who submit copyright complaints receive the information described in the Copyright Complaints procedure.
The embedded video player loads content from a third-party platform. When you play a video, that platform receives your IP address and may set its own identifiers under its own privacy policy.
7. International transfers
Where personal data leaves the European Economic Area or the United Kingdom, we rely on an adequacy decision or on Standard Contractual Clauses together with a transfer risk assessment. A copy of the safeguards is available on request.
8. How long we keep it
- Account data — for as long as the account exists, then up to 30 days after closure.
- Listening activity — up to 24 months in identifiable form, then aggregated.
- Server and security logs — up to 90 days.
- Copyright complaints and counter-notices — three years, which is the period we need to show that the repeat-infringer policy was applied consistently.
- Uploaded recordings — until the uploader removes them or the account is closed, subject to any legal hold.
9. Your rights
Depending on where you live, you may request access to your data, correction, deletion, restriction of processing, portability, and you may object to processing based on legitimate interests. Where processing relies on consent, you may withdraw it at any time without affecting past processing.
Use the removal form (choose «personal data») or write to support@audiofie.com. We respond within one month; complex requests may extend this by two further months, and we will tell you if that happens.
If you are in the EEA or the UK you may complain to your national supervisory authority. If you are in California, you also have the rights described under the CCPA/CPRA, including the right not to be discriminated against for exercising them.
10. Automated decisions
Recommendations are generated automatically from listening activity. They do not produce legal effects and do not significantly affect you. We do not use automated decision-making for account suspension without human review.
11. Children
The Service is not directed at children below the age described in the Terms of Service. If we learn that we hold data of a child below that age without the required consent, we delete it.
12. Security
We use transport encryption, hashed passwords, access controls and logging. No system is perfectly secure; where a breach is likely to result in a risk to your rights, we will notify you and the competent authority within the deadlines set by applicable law.
13. Changes
We will publish any updated version here and, where the change is material, notify registered users before it takes effect.
